
Today, the PPS formally withdrew all charges previously initiated against our client Darragh Cullen (now Club Chairman) and Edendork GAC on foot of allegations that they were involved in an illegal lottery or raffle. Our Mr Darragh Mackin acted with Mr Karl McGuckin BL for Darragh Cullen, the Chairman of Edendork GAC.
Our Mr Darragh Mackin, who acted for Mr Cullen said:
“From the outset, we have raised substantive concerns as to the premise upon which this prosecution was brought. Following detailed legal submissions, it is welcome news that the Prosecution has opted to discontinue the instant prosecution.
A GAA club, and indeed Edendork GAC, is at the centre of the community. Any attack on a GAA club and its representatives legitimately raising funds to continue to support the community should never have been called into question. Any such prosecution was, and remains, vexatious.
We now look forward to our client and the wider Edendork GAC putting this behind them. “
The statement released on behalf of Edendork GAC is repeated below:
“Edendork GAC Statement

As the membership will be aware, the Club held a successful and legitimate fundraising initiative between January and March 2021 (‘Win a Holiday Home In Ireland). This fundraiser was a competition which took place on the 20th April 2021 and was won by Mr. Richard Bloomer of Gilford, Co. Armagh.
Prior to embarking on this endeavour, the Club sought legal advice to ensure compliance with the Betting, Gaming and Lotteries & Amusements (NI) Order 1985. We ensured strict compliance with law and were both aggrieved and vexed by the subsequent PSNI investigation and prosecution which ensued. We have always robustly maintained our innocence throughout this investigation and have at all times averred that it was the Club’s intention to contest the charges as laid. The charges related to technical offences under the legislation and at no time were there any allegations of dishonesty.
The Club can now officially inform the membership that following consideration by the Public Prosecution Service, a decision has been taken to withdraw the charges against the Club and offer no evidence to the Court. As a consequence, the Club have been vindicated of any alleged criminal activity.
Over the past number of years our club has shown unwavering resilience, and determination whilst carrying this huge and unnecessary burden. However, we can state that it will not hamper or obstruct our resolve for the future. We will continue to work to ensure the development of our Club both on and off the field. Our club is at the heart of the local community with upwards of 28 teams competing across the various codes of Gaelic football, Camogie and Ladies Football. An important focus for the Club is the investment in Youth in ensuring their physical and mental wellbeing. This will remain the case.
The Club expresses gratitude to the membership for their unbridled support and loyalty. We also extend our gratitude to the wider GAA community in Tyrone who have shown and exercised considerable solidarity on this matter.
