
A High Court judge has ruled that the Northern Ireland Prison service has acted unlawfully in failing to properly consider Kieran ‘Zac’ Smyth’s request for compassionate release.
On 30th December 2023 our client Mr. Kieran ‘Zac’ Smyth successfully challenged the NIPS refusal to allow him compassionate temporary release (“CTR”) to attend his brother’s funeral
On Christmas eve (24th December 2023) Mr. Kieran Smyth’s brother Liam sadly passed away unexpectedly. As a result, our client sought compassionate temporary release (“CTR”) to attend his brothers funeral on 2 January 2024.
On Friday 29th December 2023 after 5pm a NIPS governor refused Mr. Smyth’s request for Compassionate home Leave.
On Saturday 30th December 2023 an emergency Judicial Review hearing took place before Mr. Justice Colton. Mr. Justice Colton found that the NIPS have not acted properly. The inference was disproportionate and not in accordance with law. He further found that the NIPS have not attached proper weight to Mr. Booth, Mr. Murphy chaperoning the applicant.
Mr. Justice Colton made an order of Mandamus releasing Kieran Smyth from 9am- until 3pm on Tuesday 2 January 2024 into the custody of Gavin Booth of Phoenix Law and Brian Murphy of TBM a friend of the deceased. He further found that the prison service failed to correctly interpret the gravity of the upcoming parole hearing.
Our Gavin Booth of Phoenix Law’s Actions against the Police and Prison law team said that “we welcome the decision for the court to make the order of Mandamus ordering the Prison to release the applicant. CTR is an important route for any prisoner when a loved one passed away. We thank the court for their speedy resolution to do this matter and allow the applicant release. Our client was delighted with the Court’s judgment. For the applicant it was most important that he be allowed to say his final goodbyes. it is crucial that prisoners’ rights are safeguarded, something which has been recognised in the ruling today.”
